Terms of Service

Welcome to FoodMind AI. These Terms of Service ("Terms") govern your use of the FoodMind AI mobile application and related services ("Service") provided by ENTRA LLC ("we", "us", "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who We Are

2. Eligibility
You must be 17 years of age or older to use FoodMind AI. By using the Service, you confirm you meet this requirement.
If you are using the Service on behalf of an organization, you confirm you have authority to bind that organization to these Terms.
3. Your Account
- You may create an account using your email address or by Sign in with Apple.
- You are responsible for keeping your login credentials confidential.
- You are responsible for activity that occurs under your account.
- Notify us immediately at support@foodmindai.app if you suspect unauthorized access.
- One person, one account. Sharing accounts is not permitted.
4. Subscriptions and Payments
4.1 Subscription tiers
FoodMind AI offers paid Premium subscriptions:

Prices may vary by region based on Apple's local pricing tiers and may change. Changes apply only to future billing periods after notice.
4.2 Free Trial
The Annual subscription includes a 3-day free trial. You will be charged when the trial ends unless you cancel at least 24 hours before. Cancel any time in Settings → Apple ID → Subscriptions on your device.
4.3 Auto-renewal
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your Apple ID will be charged for renewal within 24 hours before the end of the period. Manage and cancel subscriptions in your Apple ID settings.
4.4 Refunds
All purchases are processed by Apple. Refund requests must be submitted to Apple via:

- Or your Apple ID's purchase history
We have no direct refund authority. We will support reasonable requests to Apple where appropriate.
4.5 Lifetime tier
The Lifetime tier grants Premium access for as long as ENTRA LLC continues to operate the Service. It is not transferable. In the unlikely event that ENTRA LLC ceases operations or sells the Service to another entity, we will provide reasonable notice and, where commercially reasonable, transfer the Lifetime entitlement.
5. Acceptable Use
You agree NOT to:
- Use the Service for any illegal purpose
- Reverse engineer, decompile, or attempt to extract source code
- Resell, sublicense, or commercially redistribute the Service
- Submit content that is harmful, harassing, hateful, sexually explicit, or violates anyone's rights
- Use automated tools (bots, scrapers) to access the Service
- Submit deliberately misleading meal data to manipulate the AI
- Attempt to bypass the safety filters (Tessa Rule) or trigger inappropriate AI responses
- Use the Service to provide medical advice to others
We may suspend or terminate your access for violations.
6. AI-Generated Content and Medical Disclaimer
6.1 FoodMind AI is NOT medical advice
FoodMind AI provides estimates and educational information about food. It is not a substitute for professional medical, nutritional, or psychological advice, diagnosis, or treatment.
- Always consult a licensed healthcare provider for medical conditions, dietary restrictions, allergies, eating disorders, pregnancy, or any health decision.
- Do not rely on FoodMind AI for emergency medical situations — call your local emergency number.
6.2 AI estimates may be inaccurate
The AI may misidentify foods, miscalculate calories, or generate incorrect responses. We do not guarantee accuracy. You are responsible for verifying important nutritional decisions.
6.3 Safety filters
We employ safety filters (Tessa Rule §2.7) to prevent the AI from generating content that promotes restrictive eating, purging, or unhealthy weight-loss behaviors. If you experience thoughts of disordered eating, please seek professional help:

7. Your Content
You retain ownership of all photos, voice recordings, and text you submit to the Service ("User Content").
By submitting User Content, you grant ENTRA LLC a worldwide, non-exclusive, royalty-free license to process that content solely to provide the Service to you (e.g., analyze a meal photo, generate a chat response). We do not use your User Content for advertising, sale, or training external AI models.
This license terminates when you delete the content or your account, except where retention is required for legal or security reasons.
8. Intellectual Property
The Service, including all text, graphics, code, logos, designs, the FoodMind AI brand, the "Energy Score" methodology, and the ALIVE/STABLE/HEAVY/EMPTY food taxonomy, is owned by ENTRA LLC and protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, reproduce, or create derivative works of the Service without our written permission.
9. Third-Party Services
The Service integrates with third-party services (Apple, Anthropic Claude, Supabase, RevenueCat). Your use of those services is governed by their respective terms. We are not responsible for third-party services, their availability, or their content.
10. Service Availability
We strive for high availability but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, technical issues, or factors outside our control.
We reserve the right to modify, suspend, or discontinue the Service (or any feature) at any time. For paid subscribers, if we permanently discontinue the Service, we will provide reasonable notice and prorated refunds where required by law.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF DATA OR AI OUTPUTS.
WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENTRA LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
- DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE
- DAMAGES ARISING FROM ANY HEALTH OR DIETARY DECISIONS YOU MAKE BASED ON THE SERVICE
OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.
Some jurisdictions do not allow these limitations; in such cases, our liability is limited to the maximum extent permitted by law.
13. Indemnification
You agree to indemnify and hold harmless ENTRA LLC from any claims, damages, or expenses arising from:
- Your violation of these Terms
- Your User Content
- Your misuse of the Service
14. Termination
You may terminate your account at any time via Settings → Privacy → Delete My Account in the app.
We may suspend or terminate your access if you violate these Terms or for any reason with reasonable notice. On termination:
- Your right to use the Service ends immediately
- Any outstanding subscription remains active until its current billing period ends, unless we cancel for cause
- Provisions of these Terms that by their nature should survive (§§ 8, 11, 12, 13, 16) will survive
15. Changes to These Terms
We may update these Terms as the Service evolves. Material changes will be announced via in-app banner and email (where applicable). Continued use after changes take effect means you accept the new Terms.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-laws principles.
Any dispute arising from these Terms or the Service shall be resolved in the courts of Sheridan County, Wyoming, except as required otherwise by applicable consumer-protection law in your jurisdiction (EU consumers retain rights to bring proceedings in their country of residence).
